RECOMMENDATION
The Council voted on a similar motion to approve this contract at the regular meeting on February 23, 2009. It could be concluded that this is a new action because the Council will be considering the contract with the background information available. It is recommended by City Attorney Kantrud that the City Council acknowledge prior to any consideration of the Employment Contract that they are waiving their rules of procedure for reconsideration of motions and are going to take action at this meeting.
It is recommended that the City Council adopt two motions: the first approving the background report on Mr. Antonen and, second, approving an employment contract with Mr. Antonen for the City Manager’s position. [emphasis added]


If the rules as I understand them were being followed, only a councilperson on the prevailing side of a vote can offer a motion to reconsider the same action. This would mean one of councilpersons Nephew, Hjelle, or Juenemann (who voted against ratifying the contract) would need to make a motion to reconsider the action of ratifying the proposed employment contract. Since this item is even on the agenda without a reconsideration motion having been made or passed, it appears that Mr. Kantrud's advice has already been ignored.

Update (3/3/09 630am)
Mr. Hjelle's motion to approve the contract passes 4/1(Juenemann). No one mentioned the rules.
